1. Intellectual Property & Artwork Ownership
All original public artwork, murals, sculptures, and community installations cataloged on MuralNebraska are the sole intellectual property of the respective original artists.
- Personal Exploration License: Users are granted a limited, personal, non-exclusive, and non-transferable license to view the platform content and utilize our mapping tools for non-commercial exploration, game participation, and educational purposes.
- Commercial Restrictions: Downloading, reproducing, distributing, modifying, selling, or exploiting any artwork images or platform data from this website for commercial use, physical merchandise, printing, or digital reproduction is strictly prohibited without explicit, prior written consent from the copyright-holding artist.
- Protection Against AI Scraping: This platform actively deploys protocols to opt-out of automated artificial intelligence scraping. Automated harvesting or extraction of artwork, text, or database files for the purposes of training generative AI models or large language models (LLMs) is expressly forbidden.
2. User-Generated Content & Photo Submissions
MuralNebraska relies on community explorers to document, discover, and check into public art locations across the state. By submitting photographs, location metadata, text, or other creative contributions (“User Content”) to our platform, you agree to the following terms:
- Retention of Ownership: You retain full ownership of the copyright to the original photographs you take and upload to the platform.
- Grant of License to MuralNebraska: By submitting User Content, you grant MuralNebraska a worldwide, royalty-free, perpetual, irrevocable, and non-exclusive license to host, display, store, crop, resize, distribute, and promote your submitted photograph across our website, interactive maps, and community notification features.
- User Representations & Warranties: You warrant and represent that you are the sole creator and copyright owner of the uploaded photograph, or that you possess explicit, documented legal permission from the creator to upload it. You agree not to upload images scraped from search engines, professional portfolios, social media profiles, or copyrighted external databases.
- Indemnification: You agree to indemnify and hold harmless MuralNebraska, its organizers, and its community partners from any claims, liabilities, or expenses (including legal fees) arising out of your submission of photographs that violate the copyright, trademark, or privacy rights of a third party.
3. Curation, Moderation, and Right of Removal
MuralNebraska operates as a curated digital museum and community resource.
- Right of Refusal: We reserve the right, at our sole discretion, to reject, modify, reclassify, or permanently delete any User Content or mural submission that fails to meet our quality guidelines, contains inaccurate location tracking, or is suspected of copyright infringement.
- Copyright Infringement Claims (DMCA Notice): We deeply respect intellectual property. If you are an artist or photographer and believe your work has been displayed on this platform in a way that constitutes copyright infringement, please contact us immediately so we can promptly audit and remove the disputed file.
4. Platform Gamification & Exploration Points
Participation in community challenges, regional badges, and exploration leaderboard check-ins is designed for fair, real-world engagement. MuralNebraska reserves the right to audit, adjust, or revoke user account points, badges, or platform access if a user is found to be manipulating GPS locations, fabricating submissions, or undermining the community spirit of the platform.
